Lost Instrument bonds indemnify the cooperative, managing agent, and/or attorney (and in some cases, the buyer) against any loss that may occur with respect to the re-issuance of the certificate and/or proprietary lease. For a one-time premium, these bonds provide valuable protection to the interested parties when re-issuing stock certificates and/or leases.
Similarly, we underwrite Waiver of Probate bonds for instances in which a party seeks the re-issuance of a stock certificate and/or proprietary lease but does not have the authority to make the application because the actual owner is deceased or incapacitated. The bond protects the cooperative, managing agent, and attorney representing the cooperative by indemnifying them for re-issuing the lost certificate and/or proprietary lease without requiring probate of the estate. This is a valuable tool in that it protects the interested parties while saving the estate the expense and time required to apply for letters of administration or executorship.
